In the wake of Renee Good’s death at the hand of an angry, uncontrolled, ICE agent, our community showed up!
Following are the rules that ICE agents are to follow:
1. Legal Authority & Limits
ICE agents operate under federal law, primarily:
- U.S. Constitution (especially the 4th and 5th Amendments)
- Immigration and Nationality Act (INA) – 8 U.S.C. §1101 et seq.
- Federal criminal statutes (Title 18, U.S. Code)
- Department of Homeland Security (DHS) regulations
They do not have unlimited authority. Their actions must be legally justified and within scope.
2. Constitutional Requirements (Apply to ICE Like Any Law Enforcement)
Fourth Amendment – Searches & Seizures
ICE agents must:
- Have probable cause or legal authorization to arrest or search
- Obtain judicial warrants (issued by a judge), not just ICE “administrative warrants,” to:
- Enter a private home without consent
- Respect the right of individuals to refuse entry without a judicial warrant
Administrative ICE warrants do not authorize home entry.
Fifth Amendment – Due Process
ICE must:
- Provide notice of proceedings
- Allow access to legal counsel (at no government expense)
- Avoid coercion, threats, or false statements
- Respect the right to remain silent
3. Arrest Rules
ICE agents may arrest someone only if:
- They have probable cause the person is removable or has committed a federal offense
- The arrest complies with statutory authority (e.g., INA §287)
They must:
- Identify themselves as law enforcement
- Explain the reason for arrest
- Use the least intrusive means necessary
4. Use-of-Force Rules
ICE officers are governed by DHS Use-of-Force Policy, which requires:
- Force must be:
- Necessary
- Proportional
- Reasonable
- Deadly force may be used only when there is an imminent threat of death or serious bodily harm
- De-escalation is required when feasible
- Use of force must be documented and reviewed
Retaliatory or punitive force is strictly prohibited.
5. Detention Standards
ICE detention is governed by:
- ICE National Detention Standards (NDS)
- Performance-Based National Detention Standards (PBNDS)
These require:
- Access to medical and mental health care
- Adequate food, water, and hygiene
- Religious accommodation
- Protection from abuse and retaliation
- Reasonable access to attorneys and legal materials
6. Prohibited Conduct
ICE agents are explicitly prohibited from:
- Using racial, ethnic, or religious profiling
- Targeting people solely for First Amendment activity (protests, speech)
- Making false statements about legal authority
- Retaliating against individuals for filing complaints
- Engaging in sexual misconduct or harassment
- Destroying or falsifying records
7. Identification & Transparency
ICE agents are generally required to:
- Identify themselves as federal officers
- Display credentials upon request (when safe to do so)
- Wear identifying markings when in uniformed operations
They are not allowed to impersonate other agencies or misrepresent their role.
8. Coordination With Local Law Enforcement
ICE:
- Cannot compel local police to enforce immigration law unless a formal 287(g) agreement exists
- Must respect local and state laws
- Cannot override constitutional protections just because immigration enforcement is involved
9. Complaint & Oversight Mechanisms
ICE agents are subject to oversight by:
- ICE Office of Professional Responsibility (OPR)
- DHS Office of Inspector General (OIG)
- Federal courts (civil and criminal liability)
Misconduct can result in:
- Discipline
- Termination
- Civil liability
- Criminal charges
10. Key Practical Takeaway
ICE agents are law enforcement—not above the law.
They must:
- Follow the Constitution
- Respect due process
- Use force only when justified
- Be truthful about their authority
- Be accountable for misconduct
We are a small community near Houston, Texas. We believe Renee Good was murdered. Agent Ross was ready to shoot someone. We showed up over 130 strong to voice our outrage at this senseless killing.
Fox Channel 26 sent out a camera person to capture the rally. Ignore their calling us Be Aware Indivisible Kingwood. Apparently, they were confused after seeing a post warning the neighborhood about the protest.
